These Terms of Use ("Terms") govern your access to and use of the skudak.com website and the Skudak Polarity mobile app (together, the "Services"), provided by Skudak, LLC ("Skudak," "we," "us," or "our"), a New Hampshire, USA company. By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Skudak provides electric vehicle conversions, components, and consultation. The website is informational; descriptions, specifications, availability, and pricing may change at any time, and forward-looking product information (including details of products still in development, such as the Skudak VCU) is provided for general interest and is not a commitment or offer. Any conversion, component sale, or consultation is performed under a separate written agreement that governs that specific engagement.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Skudak Polarity app with your Skudak hardware for its intended purpose. The app may deliver firmware and over-the-air updates; you are responsible for following update instructions and for the safe operation of your vehicle. The app is provided "as is," and you use it and any firmware at your own risk.
All content and materials in the Services—including text, graphics, logos, images, the Skudak name and marks, and software—are owned by Skudak, LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from them without our prior written permission.
You agree not to misuse the Services, including by attempting to disrupt or gain unauthorized access to them, reverse-engineering except as permitted by law, or using them in violation of any applicable law or the rights of others.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. EV conversion and the modification of vehicles involve high-voltage systems and inherent risks; nothing on the website is technical, safety, or professional advice for your specific vehicle.
To the fullest extent permitted by law, Skudak, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Services.
These Terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be resolved in the state or federal courts located in New Hampshire, and you consent to their jurisdiction.
We may update these Terms from time to time. We'll revise the "last updated" date above, and your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
